Demande de suppressions non fondées (principalement PD-Italy et PD-France)[edit]

Une nouvelle fois, j'ai un petit souci de demande de suppressions. J'ai alerté notre ami Racconish mais si tu pouvais m'aider sur ces cas ?

@Photo2023 Quello che viene contestato è che hai fotografato materiale coperto da copyright senza avere l'autorizzazione dall'autore (da Jorit o da Lello Esposito in questi casi). Template[edit]

Ciao, ho notato che il template {{Please link images}} viene usato per segnalare ai novellini che non hanno messo la categoria, come indicato dal template {{Unc}}: Per favore notifica chi ha caricato il file con {{subst:Please link images|File:Chiesa di San Giacomo Maggiore (1).jpg}} ~~~~. Tuttavia, si spiega come fare con dei rimandi a ben due link rotti sulle parole "CommonSense" e "galleria" [1]. Di fatto, il template diventa poco utile e potrebbe creare confusione. Ciao Patafisik, il template non è protetto. Puoi provvedere a correggere direttamente i link che ti sembrano errati a Template:Please link images/it dato che WikiSense è stata dismessa. La convention de Berne parle de "rendre accessible rendre [l'œuvre] au public avec le consentement de l’auteur"[3]. C'est assez ouvert à interprétation selon moi. Une projection d'avant-première (même si à un public sélectionné) indique sans doute le pays où l'œuvre a été publiée pour la première fois. Dans ce cas, ce serait l'Italie. Bonne journée! Il ne s'agit pas de photogrammes du film mais de photos de plateau, dont il est peu vraisemblable qu'elles aient été publiées à l'occasion d'une avant-première, mais beaucoup plus vraisemblable qu'elles l'aient éventuellement été lors de la sortie en salle, qui a eu lieu en France avant l'Italie. @Racconish Ça ne change pas grand chose. Il s'agit de "photos simples" selon la loi italienne. Vu que les photos ont été faites sur le tournage, elles appartiennent à la production vu qu'aucun auteur n'est indiqué et donc le discours précédent tient toujours debout selon moi. @Racconish La discussion portait sur le pays de première publication, si je me souviens bien, à cause du fait que sur Commons on fait référence à la convention de Berne et non à la législation des états, quand ces deux sont en conflit. Hi, I wanted to ask about your closure of Commons:Deletion requests/File:Batistuta-Latorre en Boca Jrs. 1991.jpg. You closed as keep on the basis of URAA not being acceptable as a reason to delete. However, my understanding per COM:L/COM:URAA is that the policy is "A mere allegation that the URAA applies to a file cannot be the sole reason for deletion. If the end result of copyright evaluation is that there is significant doubt about the freedom of a file under US or local law, the file must be deleted in line with the precautionary principle. " I have done that copyright evaluation, and found there is no scenario where this photo can possibly be public domain in the US, because it was taken after 1989. If it was exclusively published in Argentina, then it remained in copyright in Argentina until at least 2016 (because it was taken in 1991); thus, it was in copyright on January 1, 1996, and is thus still in copyright in the US. If it was jointly published in the US and Argentina (or published solely in the US), then normal US copyright law applies; because the photo was taken after 1989, it cannot possibly be public domain until 95 years after publication. Other DRs I opened with the same rationale have closed as delete (e.g. Commons:Deletion requests/Files in Category:El Gráfico, 1989), so could you please explain your rationale for keeping?
